XUpload Free license

We wish to provide a wrapper to XUpload Free for the QCodo php framework, and release it under the MIT license.
Unfortunately, for it to work, we had to tweak the following two XUpload files:
  • upload_form.html
    upload.cgi
Would we be allowed to redistribute these modified files as part of our wrapper, or should we be supplying patches / instructions instead?

If we are allowed to distribute them, what is the exact license on these files, and how should we acknowledge it?

You can use Free code in your project, only add somewhere info that you used XUpload script from SibSoft.

Is that an official answer? We certainly don't want to proceed on that assumption only to find out later it was incorrect.

In the mean time, we are currently distributing patches that modify the XUpload default files, so that we are not distributing any XUpload code.

All users of our wrapper will have to acquire and modify XUpload Free themselves.

It would be easier however if we were permitted to distribute the files in question pre-modified. (Actually, we managed to contain modifications to the upload.cgi file alone.)
